In May of the same year, the MEC issued a decision to allow the clinics to continue operations. The MEC's decision was appealed to a Health and Disability Commissioner, who rejected the appeal in November. This led to a further appeal to the Health and Disability Appeals Tribunal, which upheld the decision in January of the following year. Legal status The operation of the MEC was a Crown-owned enterprise, and the MEC had the power to set its own conditions of entry. The MEC could license any private practitioner it wished, and the law was clear that the MEC could not refuse to license an organisation or a practitioner it regarded as unacceptable. According to one of the staff of a state-operated Well Woman clinic in the late 1990s, the state-operated clinics were "open-source" in the sense that any private practitioner with the ability to pay for the licence could apply to the MEC for a licence. Practitioners who did not receive a licence would instead be subject to professional conduct provisions in the Health Practitioners Competence Assurance Act (HPCA), which dealt with the issues of liability and malpractice. This provision was added to the HPCA following the Well Woman clinics' success.
